Harvey of South Caicos, Accused of Allegedly Raping Step Daughter gets Bail

#TurksandCaicos, August 5, 2023 – LATHARIS ANTHONY HARVEY appeared in the Supreme Court on Friday 21st July, 2023 as his matter was transferred from Grand Turk to the Supreme Court in Providenciales where he secured bail and is no longer remanded at the Department of Corrections and Rehabilitation (DCR).

Harvey had been remanded since September 2022 on allegations of raping his seven year old step child; the daughter of his (then) live-in fiancé.

The court has learned that the child and other witnesses have migrated to the United Kingdom.

Harvey’s bail was initially refused on the grounds that if released on bail which was shortly after his arrest, he would interfere with the child and/or her family.  Having learnt of the relocation of the address overseas, counsel for the accused Sheena Mair approached the court and ODPP regarding bail as her client now has changed in his circumstances for a favorable reconsideration of bail.

A sensitive disclosure was raised during the bail hearing.  Tamika Grant of the Office of the DPP strongly opposed and indicated she was not releasing, to the defense with a view of protecting the child, some evidence.

However, Sheena Mair has cited that she may need that material in support of her client’s defense.

Public prosecutor Ms. Grant then said I wouldn’t have conduct of this matter or with this file after today and it will be re-signed to another prosecutor.  She told Ms. Mair and the court, that she can then approach the new counsel and see if they will release the highly confidential and sensitive material to her.

The matter was adjourned to November 17, 2023 for pretrial review (PTR).

It was discussed in court that if counsels from both sides cannot reach an agreement on the confidential requested material, the Hon Judge Ms. Tanya Lobban Jackson will hear the issue, decide and rule as to if the defense can be given the material or not at next PTR hearing.

The accused was also given a new trial date for commencement on April15th, 2024.  His bail was extended to that date.
